@normally weird, only time I tailgate ( or get close enough to make it look like it) is when I'm in the fast lane and the person in front of me is going slow. I stay in my lane and try to convince them to move over. Because I know that I hate when people pass me in the right lane

What if the person is in a rush for a legitimate reason? They have to get to the hospital for a dying friend or their child being born? If you're going under the speed limit and they're trying to get you to go a little faster then you really shouldn't be an @ss. Especially when you don't know the circumstances.

@raywar97, wrong. It is usually automatic when someone is rear ended that the person behind them is at fault for following too closely; however if it can be proven that the person in front slammed on their brakes for no reason then they can be found at fault. You are welcome for the free lesson.

@Kalam1ty, agreed. I don't want to give into those aggressive tailgating bullies either. It is a form of bullying. Its aggressive and intimidating to tailgate someone who is going the speed limit (or just over).

@Captain Cockmonster, You are incorrect. No matter the state, if you brake and someone runs into you, they are at fault, especially if they are following at an unsafe distance. They weigh the dangers of both. Who is more of a menace, someone who brakes when there is no explicit reason to or someone who endangers multiple people by trying to force people to speed?
@Captain Cockmonster, paraphrased from my states Defensive Driving Handbook: The law is that you are responsible for keeping enough space between you and the vehicle in front of you so that if the vehicle in front stops, you can stop without hitting them, PERIOD. If you run into someone from behind you are at fault (unless it's dark and the other vehicle doesn't have proper lights or if they went in reverse).
@Kalam1ty, wrong, if you intentionally cause an accident you can be cited and be found at fault. Tell you what, next time a cop pulls up behind you, slam on your brakes, then come tell me how it worked for you. I am not saying tailgating is legal, however if it can be proven that you INTENTIONALLY caused an accident, you are wrong in most jurisdictions. End of story.
@Kalam1ty, It's illegal to hang out in the left lane. And you're not supposed to pass on the right. If someone comes up behind you going faster than you (and there aren't cars in front of you and you are able to move) you need to move over. Unless you're a police officer you have no authority to dictate how fast someone else chooses to drive.
@Captain Cockmonster, 1. Cops don't tailgate, if they have their lights on, you have to pull over. 2. If you don't have enough space between you and the car in front of you to make a stop in time, that is YOUR fault.

@Kalam1ty, you have clearly not been driving long, cops do get very close when pulling people, so go ahead and brake check them, see what happens. Brake checking is just as illegal as tailgating, period, end of story.
@Captain Cockmonster, You clearly have never worked in traffic court, or any court. I can count on one hand the times the person who was rear ended was cited, at least in my jurisdiction. Only 3 come to mind. 2 of them were cases in which it was dark and the lead car had no lights on. And the other was a reversing car. Almost 100% of tailgaters I encounter claim what you just said, and no time have I ever heard it upheld.

@Kalam1ty, Ok you can go on believing whatever you've deluded yourself with, but that is what I was taught by my parents, my drivers ed instructor, and my behind the wheel instructors. If you are on a multi lane road and the person behind you is going faster, you better move to a lane further to the right. Passing on the right is dangerous because there is a bigger blind spot. I have almost had car accidents before because I had my turn signal on and was moving over and some asś blew right by me in the right lane. Now if there is literally no one else and you're clearly not moving over, maybe yes they should just pass you on the right, but sometimes that's impossible due to other cars being spaced in a way that they wouldn't be able to speed up enough to pass you. Like I said though, if you wanted to force people to drive the speed limit, you should have become a fvcking cop, because now you're just gonna incite road rage and endanger yourself.
@shakeweight, What you are saying is to allow them to break the law. I am only in lanes if I need to be. If I am on the left side, I am going to turn left eventually, same with the right side. I will not endanger missing my turn because some @sshole wants to break the law. Tailgaters are trying to control your speed just as much as someone who slows down for them is. The only difference is, the people in front are doing it for their own safety, by going to a speed that is safe for that following distance, whereas the tailgaters have a disregard for human life and would rather get to some place than drive safely. I have taken defensive driving courses with my wife (who is very passive on the road) and if someone is riding your bumper, slow down to a safe speed. Tailgating is both stupid and illegal. What you are suggesting is equivalent to being at work, seeing a guy hanging around the backdoor with a gun and a ski mask, and you opening the back door and letting him in.
@shakeweight, by letting him speed, you are endangering many, many more people than just yourself. If you get off to the side, he might still be pissed at you. If they speed past into an intersection and through the red light (since they are blatantly disregarding laws anyway) they could kill people, same if they try to turn at 80mph and they skid through a store front.

Also I'm pretty sure this conversation is about freeways. No turning or stop lights unless you're taking an exit, which in most cases are to the right already. After driving across the country twice and from NC to FL and back numerous times I can say that I'm an expert tailgater. But I honestly should not have to do so because we're in the fast lane. If the person behind you wants to go faster, move over to the right lane. It's not only the right thing to do, but it's kind of THE LAW
@AmandaHope, also, flashing your brights over and over usually annoys people enough to get over. Mostly advise doing this during the day only though...they'll still see it. At night it's risky business
