@Sven and Otar, the lady who spilled hot coffee in her own lap won her case against McDonalds, anything is possible.
@fettman1138, I'd recommend actually reading that case. There's a lot more to it than what you saw on the news. Had to read it for a politics of law class a few years ago when we were doing a chapter on plaintiffs suing large corporations.
@fettman1138, as was already said it isnt that simple. She didnt sue because she spilled it she sued because it was served to her so hot that the spill caused severe enough burns to require extensive surgery. She was suing to have her medical expenses covered and per her insurance they wouldnt help her unless she did

@fettman1138, Adman Ruins everything I believe has an episode that talks about the Mcdonalds case. How McDonalds had several hundred complaints and were told they only needed to lower the temp 10 degree so that it wouldn’t be boiling to the point it would no longer cause 3rd degree burns. They blatantly ignored the safety warnings and complaints. And thats why the lost.
The news just parroted the story and shortened it further and further until the headline just sounded like a lady suing over something that seems trivial. Even though it wasnt. It’s actually a good test to see how gullible people are, or how grossly ill-informed about the full story when bringing up the Mcdonalds case.
To put it in a better perspective. Its the equivalency of a manufacture ignoring something that is defective in their product that could lead to physical injury and only after they get sued for it do they fix the issue or slap a warning label on it.
@Seohn, while I whole heartedly agree with you and actually had this case in a law class I took I also acknowledge frivolous lawsuits happen frequently. An old friends mom sued the city for her broken arm and won over 100k. She was riding her bike on the sidewalk and went over a raised area due to the roots of a tree and crashed. She sued for them not maintaining the sidewalk.
@Runnin with scissors, I agree frivolous lawsuits do get out of hand at times. I’m curious can the city be sued if a pothole in the road causes a car accident? I feel like that would be a similar thing.
@Seohn, more than likely they can be sued because it is their responsibility to maintain nonprivate roads and if enough complaints are logged and actually injury occurs after the complaints then they will be held responsible.
