Legit though, it's a terrible fear of mine to be falsely accused of rape, and even with all of the evidence I would have on the table, the system would still be fvcked against me
@Invalid User, Well that's the thing and I didn't want to go into the whole explanation originally.
I also think there needs to be harsh punishment for false accusations. Basically if the accusation doesn't pass the beyond a reasonable doubt standard and you are acquitted there is immediately an investigation of the accuser to determine if there is evidence that surpasses the reasonable doubt standard. If it does trial and conviction follows.
Under those circumstances I support the heaviest punishments.
@Gallchobhair, what about those falsely convicted? I know one personally. The kid came forward 5 years after confusing his mom made him lie about his step dad. We all knew it but her lawyer was good and a kid is going to do what his mom tells him to do most of the time.
@that crazy Marine, I’d rather punish an innocent person than let a child rapist walk free. I’m sorry to hear about that guy and mistakes do happen, but with kids it’s different.

@Gallchobhair, the entire point of our judicial system is to protect the innocent. If the person is already incarcerated then who are you protecting? Once we take steps that puts life long physical deformities on people who could be innocent especially in a trial that can be more he said she said where do you stop?

@that crazy Marine, This is where I employ the appeal system I blatantly stole from an Andrew Klavan podcast awhile back. Once you are sentenced you are given six months with the help of a caseworker and a group of your personal advocates to turn up any exculpatory evidence. If the evidence throws sufficient doubt that the case no longer meats the "beyond a reasonable doubt" standard the initial sentencing is reduced if no evidence is found the sentence is carried out.
@Kliment Voroshilov, doesn't always work, as in my friends case he did appeal but there really wasn't any other evidence. It wasn't until after the kid who was now a teen apologized that it changed anything. At what point is the punishment cruel and unusual? In the military I've seen a lot of punishments dealt out and with a lot of them being WTFs. You want to punish those who have done wrong but if you scar one innocent person in your pursuit of revenge it crosses the line. There's a difference between justice and revenge. They should never be mixed. Maybe you have never been on the side of the one who has harmed an innocent person because of wrong information but I tell you it's not something you live with easily after. I've seen an 8 year old girl shot in the gut by her own father just so he could have a shot at a helicopter with an RPG. I've seen evil but that doesn't mean I should kill every father who request a medevac for their shot child even if there wasn't any combat there.

Someone who touches little kids, or is convicted of it, shouldn’t be shown mercy in my opinion and no punishment is too severe. That’s just how i feel

@that crazy Marine, I dont know the entire case obviously but I find it dubious that there was no evidence that could have led to an acquittal. Either way, what happened to your friend was undoubtedly a miscarriage of justice. In the outsized number of cases though the system I've proposed would work, some modification may need made to account for extreme outside cases.
I do think you have a misunderstanding of the justice system though, part of its express purpose is revenge. As I said below somewhere the justice system is supposed to serve three purposes, retributive, deterrent and rehabilitative. The retributive purpose is the first and most important part it's exact purpose is to seek revenge, to find a punishment that is commensurate with the crime committed.

Accusation- a charge or claim that someone has done something illegal or wrong.
I'm not sure what the lack of physical evidence has to do with any of this though, not all evidence is physical.
i feel like the problems with this will wind up being the same as with the death penalty, it’ll be über expensive thanks to the appeals process and there’s inevitably gonna be a falsely-convicted guy who gets castrated

@Killing instincts , after brief research, the Washington post claims the process is reversible however these are journalists and politicians not doctors so take it with a grain of salt
@Hoban Washburne, The appeals process we have now is kind of ridiculous. You shouldn't be able to appeal a sentence endlessly.

@TheMightyImp, a friend of mine was molested as a child by her own father, which led to major trust issues, a severe lack of self esteem, depression, anxiety, an eating disorder, and multiple suicide attempts. Hard to reverse those too

Except this has been tried and has been proven not to work. Child molesters seek a power dynamic, not sexual gratification. All this is going to do is make people think it’s safe to let these people back into society, meanwhile they will re-offend, just like what happened last time this was tried. If you’re going to dish out barbaric punishments, they should at least be ones that work. These people need therapy and prison.
@tampon thief, Jusice should serve 3 purposes. Retributive, deterrent and rehabilitative. Castration falls into both retributive and deterent. I find the invocation of barbarism interesting, I would argue that barbaric punishments are exactly what should be used in retribution for barbaric behaviour. Though I do agree that castration isnt a be all end all solution it should certainly be on the table.
@tampon thief, Not really true. I've spoken to pedophiles (ones that recognize their sexuality is wrong and say they haven't touched kids) and, for them, it's entirely sexual.

I'm from Alabama. This isn't true. A state Congress woman proposed all men get snipped after 50. So they can't rape. Also if you have 3 kids you get cut.
