@Prince super Vegeta , scottles is right. It depends on the state. Its called the Castle Doctrine. Not enough states have it. 50 states would be enough. For those states that don't have it, you can get charged for murdering someone who is actively burglarizing your house. Sounds dumb, because it is. But basically you have to prove you were in fear of your life, and simply because someone is inside your house does not, by itself, warrant fear of one's life.

@Barry Dylan, I'm kind of in favor of requiring the person either enter the house or make an obvious attempt at forced entry because it prevents people from shooting someone from getting killed for approaching a home late at night. For instance one case I studied was a mans car broke down and when he approached the home the owner shot and killed him thinking he was attempting to break in.
@Lord Commander Snow, that is reasonable case to arrest the shooter, It was homicide. Stand your ground requires you to attempt to talk to them and warn them. That has always been a law I appreciate, you can stop crimes and muggings and not have the "California Consequence" (I say that because it is most predominant in very anti self defense states), where you will go to jail for attempt at assault or even attempt at murder even though you did not shoot. As someone who carries a gun legally in California, I do not pull it out of the holster. The repercussions are ridiculous. Just carrying a gun openly has gotten the cops called on me, not showing aggression just running errands.
